Introduction
These Terms of Use apply to the use of Lofumi. Marc Sogl (“we,” “us,” or “our”), Neunkirchner Straße 40, 81379 Munich, operates the Lofumi application (“this App”). The user must read this document carefully.
By installing the app, you agree to the terms of this License Agreement. If you do not agree to these Terms of Use, do not install or use this App.
License
The software is licensed, not sold. The owner grants you a non-exclusive, non-transferable, non-sublicensable, limited license to use one copy of the software for your personal, non-commercial use on your device. The rights granted herein are subject to your compliance with these Terms of Use. You acknowledge that no ownership rights in the app are transferred to you, and these Terms of Use shall not be construed as a sale of any rights to the software.
Usage Restrictions
Users are prohibited from copying, downloading (beyond the limits provided by the app), sharing, modifying, translating, reverse engineering, publishing, transmitting, selling, sublicensing, editing, transferring, or creating derivative works of the content.
Copyright
The owner retains all intellectual property rights to the content. You acknowledge that no ownership rights to the software are transferred to you. Furthermore, you acknowledge that ownership and all rights to the software remain exclusively with the owner, and you acquire no rights to the software. You may not remove or obscure any copyright or other proprietary notices of the owner.
Warranty Disclaimer
The software is provided without any warranty. The entire risk as to the quality and performance of the software lies with you. We do not guarantee that the functions of the software will meet your requirements or that the operation will be error-free.
Limitation of Liability
The owner shall not be liable for any special, incidental, or consequential damages resulting from the possession, access, use, or malfunction of the app. This includes, but is not limited to, property damage, loss of goodwill, device malfunction, and, to the extent permitted by law, damages for personal injury, property loss, lost profits, or compensation. This limitation of liability applies to the fullest extent permitted by applicable law, regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis.
Indemnification
You agree to indemnify the owner against all damages, losses, and expenses arising directly or indirectly from (i) your actions or omissions in connection with the use of the software under these Terms of Use or (ii) your breach of these Terms of Use.
Changes
We reserve the right to modify or replace these terms at our sole discretion at any time. Changes to our Terms of Use will be posted on this page. We recommend regularly checking this page for updates.
Subscriptions
Lofumi can be downloaded for free. If you choose to upgrade to Lofumi Pro, we offer monthly and annual auto-renewable subscriptions. Payments are processed through your Apple account. Subscriptions automatically renew for the same duration unless canceled at least 24 hours before the end of the subscription period. Users can try Lofumi PRO for free during a limited, non-renewable trial period. The trial period ends automatically and converts into a paid product unless canceled. Refunds for unused periods are not provided. Subscriptions can be managed or canceled in the user’s Apple App Store account settings.
Canceling Subscriptions
Unless exceptions apply, users may cancel their subscription within 24 hours for any reason and without justification. For more information on canceling subscriptions, visit:
Severability
If any provision of these terms is found to be invalid or unenforceable under applicable law, the invalidity or unenforceability of that provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
